Labwear Ventures GmbH, a company registered in Switzerland, and LWSPT Manufacturing Lda, a company registered in Portugal (together, "Labwear," "we," "us," or "our"), determine how personal information is processed in connection with our services (the "Services"), including our website at labwearstudios.com, our LabwearOS platform at labwearos.com, and any other Labwear website that links to this policy.

Labwear Ventures GmbH is the main point of contact for privacy matters relating to our Services generally. LWSPT Manufacturing Lda is involved specifically in handling orders, shipping, and contact information connected to garments manufactured in Portugal.

Information you provide

 

We collect personal information you choose to give us when you create an account, place an order, contact our support team, or otherwise interact with our Services. Depending on how you use the Services, this may include your name, phone number, email address, mailing address, username and password, billing address, and other contact or authentication details. We do not collect sensitive personal information, such as government ID numbers, precise geolocation, or biometric, health, or financial account data.

Payment information

 

Payments are processed directly by Stripe, our payment processor. Stripe collects and stores your payment details (such as your card number and security code) on our behalf; Labwear does not receive or store your full card number. You can review Stripe's privacy practices at stripe.com/de-ch/privacy.

 

Information collected automatically

 

When you visit or use our Services, we automatically collect certain technical information, such as your IP address, approximate location (derived from your IP address - we do not collect precise device-level geolocation), browser and device type, operating system, language preference, and information about the pages you view and features you use. We use this information to keep our Services secure and functioning correctly, and for internal analytics.

 

3. How We Use Your Information

 

We use the information described above to:

  • Create and manage your account

  • Provide and deliver the Services you request

  • Respond to your questions and provide support

  • Send administrative communications, such as updates to our terms or this policy

  • Fulfil and manage orders, payments, returns, and exchanges

  • Protect the vital interests of you or others, such as to prevent harm

 

4. AI-Powered Features

 

Certain features of our Services are powered by artificial intelligence: an automated customer-support chat, and a quotation engine that generates estimates for garment development, sampling, and production based on the specifications you provide. Both features are powered by Google Cloud AI. When you use them, the information you submit (such as your messages or product specifications) and related account details are processed by Google Cloud AI on our behalf, for the purposes described in this policy. Please avoid submitting information through these features that you would not otherwise share with us directly.

 

5. Cookies and Similar Technologies

 

We use cookies and similar technologies (such as pixels) to keep our Services secure, remember your preferences, and understand how our Services are used. We use Google Analytics for this purpose, which collects information such as your approximate location, device and browser type, and the pages you visit.

 

We do not currently use cookies or similar technologies for interest-based or retargeting advertising, and we do not sell or share your personal information with third parties for cross-context behavioural advertising.

 

Most browsers let you block or delete cookies through their settings, though this may affect how our Services function. To opt out of Google Analytics specifically, you can install the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout).

 

6. Legal Bases for Processing Your Information

 

European Economic Area, United Kingdom, and Switzerland

 

If you are located in the EEA, UK, or Switzerland, we process your personal information on one of the following bases: your consent (which you may withdraw at any time), the performance of a contract with you, compliance with a legal obligation, or the protection of vital interests. As a Swiss company, Labwear Ventures GmbH is also subject to the Swiss Federal Act on Data Protection (FADP), which applies alongside these principles where you are located in Switzerland.

 

Canada

 

If you are located in Canada, we rely on your express or implied consent, which you may withdraw at any time. In limited circumstances permitted by Canadian law, we may process your information without consent - for example, for fraud prevention and investigation, to comply with a court order or subpoena, in connection with a business transaction, or where the information is already publicly available.

 

7. Who We Share Your Information With

 

We share personal information with service providers who perform functions on our behalf, under contracts that limit their use of your information to the purposes we specify. These providers currently include:

  • Stripe - payment processing

  • Google Cloud AI - AI-powered support chat and quotation engine

  • Microsoft Azure - cloud computing and hosting infrastructure

  • Twilio and SendGrid - customer communications and email delivery

  • Wix - website hosting

  • Datadog - website performance monitoring

  • Google Analytics - website analytics

 

We may also share information: (i) in connection with a merger, acquisition, financing, or sale of company assets; and (ii) with our affiliates, including LWSPT Manufacturing Lda and any future subsidiaries or joint ventures under common control, who will handle your information consistently with this policy.

 

8. International Data Transfers

 

We and our service providers process and store personal information in Switzerland, the European Union (including Germany and Portugal), the United States, and other countries where our providers operate. Where we transfer personal information out of the EEA, UK, or Switzerland, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses and equivalent mechanisms for transfers from Switzerland. Copies of these safeguards are available on request.

 

9. How Long We Keep Your Information

 

 

We keep your personal information for as long as necessary for the purposes described in this policy - generally for as long as you maintain an account with us - unless a longer period is required by law (for example, tax or accounting requirements). Once we no longer need it, we delete or anonymise it, or, where that isn't immediately possible (such as information in backup archives), we securely store it and restrict further use until deletion is possible.

We use reasonable technical and organisational measures designed to protect your personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee that unauthorised third parties will never be able to defeat our safeguards. Transmission of information to and from our Services is at your own risk.

Our Services are not directed to, and we do not knowingly collect personal information from, anyone under 18 (or the age of majority in their jurisdiction, if higher). By using our Services, you confirm you meet this age requirement, or that you are a parent or guardian consenting on behalf of a minor dependant. If we learn we have collected information from someone under this age, we will delete it and deactivate the related account. Depending on where you live, you may have rights under applicable data protection law, including the right to access, correct, delete, or receive a copy of your personal information; to restrict or object to certain processing; and to not be subject to solely automated decisions that produce legal or similarly significant effects (with a right, where applicable, to request human review). Withdrawing consent: where we rely on your consent, you may withdraw it at any time by contacting us; this will not affect the lawfulness of processing carried out before withdrawal.

 

Marketing communications: you can unsubscribe at any time using the link in our marketing emails, or by contacting us. We may still send you non-marketing, service-related messages.

 

Account information: you can review or update your account by logging in, or ask us to deactivate or delete it by contacting us. We may retain limited information as needed to prevent fraud, resolve disputes, enforce our agreements, or comply with legal obligations.

 

EEA and UK residents also have the right to lodge a complaint with their local data protection authority; Swiss residents may contact the Federal Data Protection and Information Commissioner (FDPIC).

 

US state residents

 

Depending on your state of residence, you may also have the right to know what personal information we process, to obtain a copy of it, to correct or delete it, to opt out of the sale or sharing of personal information or its use for targeted advertising, and to not be discriminated against for exercising these rights. We do not sell or share personal information, as described in "Cookies and Similar Technologies" above.

We may need to verify your identity before processing your request, and where permitted by law you may designate an authorised agent to act on your behalf. If we decline a request, you may appeal by emailing us; we will respond in writing, and if your appeal is denied, you may contact your state attorney general.

 

California residents may also request, once per year and free of charge, information about any personal information we disclosed to third parties for direct marketing purposes in the prior calendar year, under California Civil Code Section 1798.83.

 

13. Do Not Track

 

Some browsers offer a "Do Not Track" setting. Because there is no common industry standard for how businesses should respond to it, we do not currently respond to Do Not Track signals.

 

14. Changes to This Policy

 

We may update this policy from time to time. If we make material changes, we will update the date at the top of this policy and, where appropriate, notify you directly or through a notice on our Services.
